  • Extra informatie: - The most comprehensive and first monograph on inheritance law in the BGB was presented by Julius Binder (1870-1939), professor of law in Rostock, Erlangen and Göttingen. This third part, published in 1905, completes the section on the "Legal status of the heirs", which includes the legal relationships of the co-heirs and their liability for the debts of the estate. The part concludes with the doctrine of inheritance rights. I: Acquisition of the inheritance II: Acceptance and renunciation of the inheritance III: Legal status of the heir before acceptance IV: The legal status of the heir after acceptance of the inheritance V: Majority of the heirs VI: Protection of inheritance law VII: Source and factual register The Inheritance law also reflects social and legal policy objectives. In the Holy Roman Empire, the primary goal was to keep the wealth of middle-class families together. However, the Enlightenment and liberalism changed the fundamentals. The idea of equality between people led, among other things, to the result that the testator's children should receive equal shares in the legal succession. At the same time, large fortunes should not be kept together, since it opposed the idea of de facto equality in society.
